Whistleblowing

Article 6 paragraph 2-bis of Legislative Decree 231/01 – introduced by law 179/2017 containing “Provisions for the protection of those reporting crimes or irregularities of which they have become aware in the course of their employment relationship, public or private “– provides for the adoption of a system that makes it possible to report to the Supervisory Body suspicions of any illegal conduct, carried out in violation of the provisions of the Model itself, as well as facts and/or behaviours that are integral to one of the offenses envisaged by Legislative Decree 231 of 2001 and/or other activities that do not comply with company procedures and policies.

For this reason, employees, collaborators, lawyers and third parties who act in the name and on behalf of the companies belonging to Gruppo Manifatture Italiane and/or who have a business relationship with them will be able to report to their Supervisory Bodies through the e-mail addresses on this page.

The Supervisory Body to which the report is addressed will verify its validity and will handle it in compliance with the legislative provisions pursuant to art. 6 of Legislative Decree 231/2001, as well as with the principle of the confidentiality of the whistleblower.

The reports that are sent must, in any case, be in good faith and well-founded and, therefore, based on precise and consistent elements, therefore the whistleblower is asked to accurately describe the facts that are the subject of the report, indicating the persons involved and/or those who can relate the facts, and attaching, if necessary, all useful documentation.

In any case, it should be remembered that if the report being assessed is manifestly unfounded and made with willful misconduct or gross negligence by the whistleblower, disciplinary proceedings may be initiated against the latter at the initiative of the Supervisory Body.

Nevertheless, the fact remains that the reports may be submitted by internal mail or by the normal postal service, by registered letter with return receipt to be addressed to the attention of the Supervisory Body of Gruppo Manifatture Italiane S.p.A. or of one of the other companies of the group. In this case, in order to guarantee the confidentiality of the whistleblower, it will be the responsibility of the latter to send the report to the Supervisory Body using a sealed envelope, clearly marked “Strictly confidential. Reserved for the supervisory body”.
